If you are using the Platform on behalf of an organization (such as an educational institution), you represent and warrant that you have the authority to bind that organization to these Terms.

LYAH provides an innovative e-learning platform that integrates voice artificial intelligence technology to deliver interactive, personalized educational experiences. Our services include:

• Access to AI-powered interactive lessons and courses
• Personalized learning pathways with adaptive difficulty
• Performance analytics and progress tracking
• Downloadable educational materials and session transcripts
• Virtual instructor interactions through voice AI technology

3. User Eligibility and Registration

3.1 Age Requirements

• Users under 13 years of age may only use the Platform with verifiable parental consent in compliance with COPPA
• Users between 13-18 years must have parent or guardian permission
• Educational institutions may register students according to their institutional agreements

3.2 Account Creation

To access the Platform, you must:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update any information to keep it accurate
• Accept responsibility for all activities under your account
• Immediately notify us of any unauthorized use

4. Acceptable Use Policy

4.1 Permitted Use

• Attempt to gain unauthorized access to any systems or networks
• Harvest or collect information about other users
• Use the Platform in ways that could damage our reputation or business
• Exceed usage limitations (including the 3-hour limit per AI-powered interactive session)
• Use automated systems or bots to access the Platform
• Misrepresent your identity or affiliation

5. Intellectual Property Rights

5.1 LYAH's Proprietary Rights

All content, features, and functionality on the Platform, including but not limited to:

• Software, algorithms, and AI models
• Text, graphics, logos, and images
• Audio and video content
• Platform design and interface
• Methodologies and teaching approaches

are owned by LYAH or its licensors and are protected by international copyright, trademark, patent, and trade secret laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended educational purposes during your subscription period.

5.3 User-Generated Content

By submitting content to the Platform, you grant LYAH a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for providing and improving our services.

6. Privacy and Data Protection

6.1 Data Collection and Use

Our data practices are governed by our Privacy Policy, which complies with:

• General Data Protection Regulation (GDPR)
• Children's Online Privacy Protection Act (COPPA)
• Family Educational Rights and Privacy Act (FERPA)

7. Educational Content and Academic Integrity

7.1 Educational Support Tool

The Platform is designed as an educational support tool. For students using the Platform through educational institutions:

• AI-generated evaluations are recommendations only
• Final academic decisions remain with teachers and institutions
• The Platform does not make binding academic assessments

7.2 Academic Honesty

Users must maintain academic integrity and comply with their institution's policies regarding:

• Appropriate use of AI assistance

8. Usage Limitations and Technical Requirements

8.1 Session Limits

• Interactive AI sessions are limited to 3 hours per session
• Users exceeding this limit will have access restricted for 48 hours
• Additional limitations may apply based on your subscription tier

8.2 Technical Requirements

You are responsible for ensuring:

• Adequate internet connectivity
• Compatible devices and browsers
• Sufficient technical infrastructure
• Updated software and security patches

9. Payment Terms (for Direct Subscribers)

If you purchase services directly:

• All fees are due according to the payment schedule selected
• Prices exclude applicable taxes
• Late payments may result in service suspension
• No refunds for partial subscription periods unless required by law

10. Disclaimers and Limitation of Liability

10.1 Service Availability

The Platform is provided "AS IS" and "AS AVAILABLE." We do not guarantee:

• Uninterrupted or error-free service
• Compatibility with all devices or systems
• That the Platform will meet all your requirements
• Complete accuracy of AI-generated content

10.2 Limitation of Liability

To the maximum extent permitted by law:

• LYAH's total liability shall not exceed the fees paid by you in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages
• We are not liable for loss of data, profits, or business opportunities

10.3 Educational Outcomes

LYAH does not guarantee specific educational outcomes or improvements in academic performance.

11. Indemnification

You agree to indemnify and hold harmless LYAH, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your misuse of the Platform
• Your violation of any third-party rights
• Content you submit to the Platform

12. Accessibility

13. Modifications to Terms

14. Termination

You may stop using the Platform at any time by closing your account.

14.2 Termination by LYAH

• Suspicious or fraudulent activity
• Non-payment (where applicable)

14.3 Effect of Termination

Upon termination:

• Your license to use the Platform ends immediately
• You may have up to 60 days to retrieve your data (unless terminated for violation)
• Sections that by their nature should survive termination will remain in effect

15. Dispute Resolution

These Terms are governed by the laws of Spain, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes shall be resolved exclusively in the courts of Madrid, Spain, unless otherwise required by your local consumer protection laws.
